Terms of Service

These terms govern access to the Junge Technology website and services.

1. Scope of Services

Junge provides software quality assurance and testing services, including manual, functional, website, mobile application, compatibility, regression, user acceptance testing support, test documentation, defect reporting, and related QA consulting.

Specific scope, deliverables, environments, devices, browsers, responsibilities, assumptions, schedules, fees, and acceptance criteria are defined in the applicable written proposal or agreement.

2. No Guarantee of Defect-Free Software

Testing reduces risk but cannot prove that software is entirely free from defects, vulnerabilities, interruptions, compatibility issues, or future failures. Unless agreed in writing, Junge does not guarantee that every issue will be identified or that a product will achieve a particular commercial, technical, security, compliance, performance, or user-experience outcome.

Results reflect the agreed scope, supplied environment, available information, tested versions, devices, browsers, data, and conditions at the time of testing.

3. Client Responsibilities

Clients must provide accurate information, timely decisions, suitable documentation, authorised access, test accounts, test data, environments, and other materials reasonably required for the services.

  • Ensure the right to provide all supplied systems, data, credentials, and materials.
  • Maintain appropriate backups and recovery procedures.
  • Disclose known risks, restricted actions, production limitations, and security requirements.
  • Ensure requested testing is lawful and authorised.
  • Review findings and make final product, compliance, security, and release decisions.

4. Access, Test Data & System Security

Junge uses client-provided access only for the agreed services and takes reasonable measures to protect credentials and non-public information. Test or staging environments and non-production data should be used wherever practical.

Clients must not provide regulated or highly sensitive data unless its use is necessary, lawful, disclosed in advance, and covered by written safeguards. Production testing is performed only when expressly authorised.

5. Confidentiality

Non-public information may include source code, credentials, data, product roadmaps, unreleased features, designs, documentation, pricing, bug reports, test results, and technical or commercial information.

Each receiving party will use confidential information only for the engagement, protect it with reasonable care, limit access to people who need it and are subject to confidentiality obligations, and not disclose it without permission except where required by law.

These obligations continue for three years after the relevant engagement ends, while trade secrets remain protected for as long as they qualify as trade secrets. A separate non-disclosure agreement may be used where additional protection is required.

6. Third-Party Services & Platforms

Services may involve third-party browsers, devices, hosting providers, app stores, APIs, analytics tools, project-management systems, and testing platforms. Junge does not control third-party availability, policy changes, restrictions, outages, or security incidents. Clients remain responsible for complying with the terms of third-party services they authorise Junge to access.

7. Intellectual Property

Each party retains ownership of intellectual property, tools, data, trademarks, processes, templates, and know-how owned or developed independently before the engagement.

Subject to full payment, clients may use final client-specific reports and deliverables for internal business purposes. Junge retains ownership of its methods, reusable templates, general knowledge, utilities, and non-client-specific processes. Client materials are accessed only to perform the agreed services.

Junge will not publicly identify a client or use client names, logos, products, screenshots, or engagement details in marketing without permission.

8. Proposals, Fees & Payment

Service fees, payment schedules, taxes, expenses, currency, and invoice terms are stated in the applicable proposal or agreement. Work may be paused for overdue amounts after reasonable notice. Unless required by law or stated in the engagement document, fees for completed work, reserved capacity, or committed third-party costs are non-refundable.

9. Changes, Delays & Service Modifications

Requests outside the agreed scope may require revised timing, fees, or deliverables and will be confirmed before additional work begins. Junge may reschedule, suspend, or decline activities that are unlawful, unsafe, unauthorised, technically impractical, or outside the agreed scope.

10. Reports & Release Decisions

Bug severity, priority, risk ratings, and release-readiness observations are professional assessments based on the available information and agreed scope. Clients remain responsible for implementing fixes, conducting legal or regulatory reviews, maintaining security, and deciding whether and when to release a product.

Unless included in scope, Junge is not responsible for correcting defects, modifying source code, deploying releases, operating client systems, or verifying later changes.

11. Warranties

Junge will perform agreed services with reasonable care and skill. Except as expressly stated in a written agreement and to the maximum extent permitted by law, other warranties, representations, and conditions are excluded.

12. Limitation of Liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or loss of profits, revenue, goodwill, opportunity, anticipated savings, or data connected with the services.

Junge's total aggregate liability arising from an engagement will not exceed the fees paid or payable for the specific services giving rise to the claim during the six months preceding the relevant event. Nothing excludes liability that cannot legally be excluded, including fraud or fraudulent misrepresentation.

13. Termination

Either party may terminate an engagement according to the applicable proposal or agreement. Where none is stated, either party may terminate with reasonable written notice, or immediately for an unremedied material breach, unlawful performance, or material security risk.

Clients must pay for services performed, approved expenses, reserved work, and non-cancellable commitments up to termination. Terms intended to survive termination remain in force.

14. Website Information

Website content is general information and may change without notice. It is not legal, security, compliance, financial, or other regulated professional advice. Junge does not guarantee uninterrupted availability or that every item of website content is always complete, current, or error-free.

15. Governing Law & Disputes

These Terms and related non-contractual obligations are governed by the laws of Malaysia, without regard to conflict-of-law principles. The courts of Malaysia have exclusive jurisdiction unless the parties agree to another dispute-resolution process in writing.

16. Changes to These Terms

Junge may update these Terms from time to time. The latest version will appear on this page with a revised effective date. Changes do not retroactively alter a signed agreement unless both parties agree in writing.

17. Contact

Questions about these Terms can be raised through the Contact page. Legal company details and a direct legal contact will be included in the final public release documentation.
